Yakiba 焼刃: The term Yakiba literally means the Tempered edge.  The edge of the Japanese sword or Nihonto, commonly known as the Hamon.

ABOUT ME:

I have been a collector and student of Nihonto for 30+ years. As with many collectors I was first officially introduced to the Japanese Sword through the Martial Arts. I saw my first Japanese sword as a young boy and it was love at first sight. I have maintained a lust for Nihonto and Tosogu since that day.

I would like to acknowledge a debt of gratitude to my two good friends and mentors, WW II Marine Corp Aviator, Colonel Dean Hartley and Dr. T.C. Ford. Dean was one of the oldest collectors in the US, with a history of Nihonto study and collection which spanned over fifty years. Dean was instrumental in forming almost every sword club in the US, and was President Emeritus of the JSS/US until his death in 2010. Over the years the Col. has treated me like a son, sharing his incredible knowledge as well as opening his vast collection for my study.

T.C. Ford or Carrol as his friends knew him was another instrumental figure in the formation of sword clubs in the US. He was the editor of the JSS/US Newsletter for many years. He wrote the forward in John Yumoto’s, The Samurai Sword. Dr. Ford was very kind and sharing of his knowledge.  He took me under his wing and was like family. I spent many a weekend at his home studying swords and fittings.  He was always pushing me to learn more, and it was common when I would leave for home, he would hand me a Juyo or Tokubetsu Juyo sword and say “take this home and study it until you return”. That kind of friendship is priceless.

To provide Japanese Swords, Fittings in a variety of price ranges for all collectors.

Our primary emphasis here at Yakiba is Antique Japanese Swords or Nihonto, and Antique Sword Fittings or Tosogu. Other facets of Japanese Art, such as Yakimono, Kakemono, etc. will be offered when available.

Per the request, I have agreed to occasionally offer Training Weapons. This page will be separate and clearly defined from Nihonto and time to time will offer a limited number of functional reproduction weapons for rigorous martial training.

THESE INSTITUTIONS INCLUDE BUT ARE NOT LIMITED TO THE NBTHK, NTHK (X 2), NIHON TO TOSOGU KYUKAI, FUJISHIRO, ETC.  IN THE LISTINGS THESE MAY BE REFERRED TO COLLECTIVELY AS “PAPERS”, BUT SHALL BE IDENTIFIED ACCORDINGLY.

NOTE: PLEASE NOTE THESE AFOREMENTIONED AUTHENTICATION “PAPERS” ARE NOT GUARANTEES, BUT AN EDUCATED OPINION BY THE FOREMOST SCHOLARS OF NIHONTO.

NOTE: Nearly all swords are subject to some Hakikake or light scuffs, surface scratches, tarnished areas, kitte ware, etc. Some schools forged a large or loose hada. This is not a flaw, but an important kantei point.

I will make every effort to not offer swords with fatal flaws!! However, I am only human and occasionally one may slip through. On the rare occasion that I receive a sword with a known fatal flaw, it will be clearly defined, the area photographed, and it shall be priced accordingly. If by chance such a fatal flaw escapes detection on inspection I will refund your payment price as long as I am notified and sent photographic evidence within the 48 hr. inspection inspection period.

*Be sure you inspect your sword as soon as it arrives to avoid any potential conflict.

High quality Japanese Swords are very expensive!  Swords in the lower price ranges are offered as a courtesy, however please note that the lower priced swords are subject to be in a poorer state of polish and condition. Remember the old saying, You get what you pay for!  All swords sold for $5000 USD or less are considered final!

Swords above the $5000 range may be returned for any reason within 48 hrs.  Meaning, intent of return must be received within 48-hrs of buyer receiving the item.

Please examine your new sword promptly and efficiently.

Once the 48 hr. inspection period has passed there will be no returns or warranty offered, implied or honored.

I reiterate, please examine your new sword prior to the 48 hr. inspection period ending.

IN THE EVENT THAT AN ITEM IS ACCEPTED FOR RETURN, IT MUST BE RETURNED IN EXACTLY THE SAME CONDITION AS SENT. BUYER IS RESPONSIBLE FOR ITEM UNTIL RETURNED ITEM IS RECEIVED. CONSIGNEE, YAKIBA RESERVES THE SOLE RIGHT IN DETERMINATION OF RETURNED ITEMS CONDITION.

All items are sold as advertised through written and photographic description. Items are described to the best of our ability, and all information is assumed correct but not guaranteed. Measurements of swords and especially fittings are done to the best of our ability, however small discrepancies may arise when comparisons are made. Therefore, size measurements shall be considered approximate and not guaranteed unless the difference is greater than 1.0″ (2.5cm) for swords, and 0.25″ (0.635 cm) for fittings.

It was quite common in the past for swords and fittings to be falsely signed. The term for this is gimei. No guarantees shall be made in regard to attributions of items signed,  unsigned, papered or not papered.

* This includes items accompanied by authentication papers from an accredited institution such as those listed above. While widely accepted,  authentication papers are no more than an educated opinion. Granted, they are the opinions of some of the best experts in the world, they are still opinions and are not guaranteed by the issuing body.

Likewise, opinions differ and attributions are subject to change if re-submitted for any reason.

YAKIBA will assume no responsibility or liability for shinsa results by any issuing institution. Any dispute which should arise in this regard must be resolved directly with the issuing institution.

In regard to signed items with no papers, available information found inscribed on an item shall be provided as a courtesy. This information is neither a guarantee, nor an opinion in regard to the authenticity of the date, signature, or inscription. It is nothing more than the translation of what is inscribed upon any given item.

Information, if available regarding the period, school or maker whose name is inscribed on items may also be provided, again as a courtesy only, not a guarantee. I may provide an opinion on any given item, but it is an opinion only.  It is important the buyer to do his/her own research in order to formulate their own opinion and make an educated decision in regard to whether or not the item is right for them.

We research and do our best to be absolutely correct in our representations and translations. Please note however, that Japanese is not our native language. Many native Japanese misinterpret the kanji found in sword and fittings inscriptions. Therefore, Yakiba will not assume any responsibility or liability in any misinterpretation or erroneous information or translations. Therefore, in regard to signatures, inscriptions, and information, all items are sold “as is”.

ALL ITEMS SHALL BE SHIPPED PER USPS OR EMS WHEN APPLICABLE.

HIGHER VALUE ITEMS MAY REQUIRE SHIPPING PER UPS IN ORDER TO ADEQUATELY PROVIDE INSURANCE COVERAGE FOR ITEMS EXCEEDING USPS MAXIMUM COVERAGE AMOUNTS.

CONSIGNMENTS:

YAKIBA, HEREBY REFERRED TO AS CONSIGNEE, IS NOW ACCEPTING CONSIGNMENTS WITH THE FOLLOWING CONDITIONS:

  1. BY SENDING ITEMS TO BE SOLD THROUGH YAKIBA WEBSITE, YAKIBA’S OWNERS OR AGENTS SHALL CONSTITUTE YOUR AGREEMENT OF ENTRY INTO A CONTRACT OF CONSIGNMENT.
  2. ALL TRANSACTIONS SHALL BE IN US DOLLARS, NO EXCEPTIONS.
  3. ALL ITEMS ARE SUBJECT TO A 25% COMMISSION FEE OF THE FINAL SELLING PRICE, PLUS ANY ADDITIONAL FEES INCURRED RELATED TO THE SELLING OF THE ITEM.
  4. IF UNSOLD THERE WILL BE A LISTING FEE PER EACH ITEM, WHICH MUST BE PAID BEFORE THE CONSIGNED ITEMS ARE RETURNED. FEES ARE, $250 PER SWORD AND $100 PER TSUBA, PAIR OF MENUKI, OR FUCHI / KASHIRA. ANY OTHER ITEMS MUST BE DISCUSSED PRIOR TO ACCEPTANCE.

THIS FEE COVERS THE COST OF MY TIME TO PROFESSIONALLY SHOOT, EDIT, RE-SIZE, NAME AND STORE YOUR PHOTOS AS WELL AS RESEARCH, MEASUREMENTS AND WRITING LISTING DESCRIPTIONS.  OBTAINING HIGH QUALITY PHOTOS OF JAPANESE SWORDS IS VERY DIFFICULT.  IF YOU HAVE DOUBTS, TRY IT.

  1. BY ACT OF OFFERING AN ITEM FOR CONSIGNMENT, CONSIGNOR HEREBY GUARANTEES THAT THE ITEM LEGALLY BELONGS TO THEM WHOLLY OR CONSIGNOR HAS POWER OF ATTORNEY IN REGARD TO SELLING SAID ITEM. ANY AND ALL ITEMS OFFERED FOR CONSIGNMENT MUST BE FREE FROM LIENS, JUDGMENTS OR ENCUMBRANCES OF ANY KIND.
  2. FOR CONSIGNMENT ITEMS TO BE ACCEPTED, CONSIGNOR MUST AGREE TO A TWO (2) YEAR MINIMUM LISTING TIME. THE MANDATORY TERM SHALL START THE FIRST DAY LISTING IS PUBLISHED AND AVAILABLE TO THE PUBLIC ON THE WEB SITE. NO MAXIMUM TIME LIMITS SHALL BE IMPOSED. CONSIGNMENT LISTINGS MAY BE TERMINATED AFTER THE TWO YEAR MINIMUM, BY WRITTEN NOTIFICATION, WITH ONE EXCEPTION: IF THE SALE IS IN ACTIVE PROCESS IE; IF PAYMENT HAS BEEN SENT OR RECEIVED FOR A CONSIGNED ITEM AND IS AWAITING ARRIVAL OR CLEARANCE INTO MY ACCOUNT, IT SHALL BE CONSIDERED SOLD AND SUBJECT TO THE TERMS OF THIS AGREEMENT. IN THE EVENT OF TERMINATION OF LISTING AFTER THE TWO YEAR MINIMUM REQUIREMENT, ANY FEES INCURRED MUST BE PAID PRIOR TO THE RETURN OF CONSIGNED ITEM(S).
  3. YAKIBA CONSIGNMENT SALES SHALL FALL UNDER THE SAME “SALE POLICIES” AS LISTED ABOVE. SALE OF ALL CONSIGNMENT ITEMS UNDER $5000 USD SHALL BE CONSIDERED FINAL.
  4. WHILE LISTED ON MY WEB SITE, CONSIGNOR AGREES TO GRANT YAKIBA AND ITS OWNER OR AGENT THE EXCLUSIVE RIGHT OF REPRESENTATION FOR SALE. ANY VIOLATION OF THIS CONDITION SHALL CONSTITUTE A BREACH OF CONTRACT AND SHALL RESULT IN YOUR ITEM BEING REMOVED FROM THE WEB SITE AND FORFEITURE OF YOUR LISTING FEES. IF ANYONE OTHER THAN YAKIBA SELLS THE ITEM WHILE LISTED FOR SALE ON MY WEB SITE, THE CONSIGNOR AGREES TO PAY THE FULL 25% COMMISSION PER THE EXCLUSIVE LISTING AGREEMENT.
  5. THE ASKING PRICE, AS WELL AS THE ACCEPTANCE OF ANY OFFERS WILL BE THE CONSIGNOR’S (OWNER) SOLE DECISION. YAKIBA SHALL REMAIN NEUTRAL IN THIS REGARD AND ACT AS ONLY AS A MEDIUM FOR PRESENTATION OF CONSIGNMENT ITEMS, WITH COMMISSIONS DUE ON FINAL SELLING PRICE.
  6. PAYMENT TO CONSIGNOR WILL BE SENT WITHIN FIVE BUSINESS DAYS OF PURCHASE. ONCE PAYMENT IS RECEIVED AND HAS COMPLETELY CLEARED INTO MY ACCOUNT AND / OR THE 48HR. INSPECTION PERIOD HAS ELAPSED. PAYMENT SHALL BE MADE IN THE METHOD OF MY CHOICE, IE; PERSONAL CHECK, MONEY ORDERS, WIRE TRANSFERS, ETC.
  7. ALL CONSIGNMENT ITEMS SHALL BE DESCRIBED TO THE BEST OF MY ABILITY; THIS INCLUDES ACCURATE DESCRIPTIONS OF NEGATIVE POINTS AS WELL AS POSITIVE ONES. THESE DESCRIPTIONS SHALL BE AS FAIR AS POSSIBLE FOR BOTH PARTIES, THEY SHALL BE NON-JUDGMENTAL AND DONE WITHOUT MALICE, ACERBITY OR AGGRANDIZEMENT.
  8. CONSIGNOR AGREES AND GIVES FULL PERMISSION TO CONSIGNEE, YAKIBA, TO PHOTOGRAPH, DESCRIBE AND LIST THE CONSIGNED ITEM IN WHATEVER MANNER CONSIGNEE SEES FIT. ALL PHOTOS AND INFORMATION TAKEN, SUPPLIED, OR OBTAINED IN ANY MANNER MAY BE USED IN ANY CAPACITY BY CONSIGNEE, BEFORE, DURING OR AFTER ITEM HAS BEEN LISTED OR SOLD. ALL PHOTOGRAPHS TAKEN OR SUPPLIED BY CONSIGNER OR CONSIGNEE SHALL BECOME THE PROPERTY OF YAKIBA.
  9. CONSIGNMENT ITEMS SHALL BE LISTED ASAP, HOWEVER, PLEASE NOTE THAT PHOTOGRAPHING, EDITING, RESEARCH AND WRITING DESCRIPTIONS ARE VERY TIME CONSUMING AND WILL NOT BE RUSHED. THIS MUST BE DONE PROPERLY IN ORDER TO ENSURE ACCURACY AND QUALITY. YAKIBA STOCK WILL TAKE PRECEDENCE IN LISTING OVER CONSIGNMENT ITEMS.
  10. CONSIGNEE, YAKIBA WILL NOT BE HELD RESPONSIBLE OR LIABLE FOR ANY FALSE OR INACCURATE INFORMATION GIVEN TO BUYERS OR OBTAINED FROM CONSIGNOR, OR ANY SOURCE. THIS INCLUDES ANY INADVERTENT MISTAKES BY CONSIGNEE AS WELL.
  11. CONSIGNOR UNDERSTANDS AND AGREES THAT HE/SHE ALONE IS RESPONSIBLE FOR MAINTAINING ADEQUATE INSURANCE ON ANY AND ALL CONSIGNMENT ITEMS WHILE ENROUTE TO/FROM CONSIGNEE AS WELL AS WHILE IN THE POSSESSION OF YAKIBA FOR THE DURATION OF SAID CONSIGNMENT. THIS INCLUDES BUT IS NOT LIMITED TO TRAVELING TO/FROM SHOWS, WHILE ATTENDING SHOWS, ETC. YAKIBA WILL NOT /CAN NOT PROVIDE CONSIGNMENT ITEMS WITH INSURANCE OF ANY KIND.
  12. CONSIGNOR(S) THROUGH THE ACT OF CONSIGNMENT OF THEIR ITEMS WITH YAKIBA, DO HEREBY WAIVE, RELINQUISH AND RELEASE CONSIGNEE YAKIBA, MARSHALL PROPERTIES LLC. AND ITS OWNERS FROM ANY AND ALL LIABILITIES WHICH MAY ARISE FROM LOSS, THEFT, DAMAGE, FLOOD, FIRE, DISASTER OR WHILE TRAVELING TO OR FROM ANY SHOWS. AS WELL AS WHILE IN THE POSSESSION OF CONSIGNEE OR DESIGNATED AGENT FOR ANY REASON.
  13. THROUGH THE ACT OF CONSIGNING ITEMS WITH YAKIBA, CONSIGNOR GRANTS HIS/HER PERMISSION FOR CONSIGNEE (YAKIBA) TO TAKE, TRAVEL WITH CONSIGNED ITEMS TO VARIOUS SHOWS AROUND THE COUNTRY AS PART OF THE ATTEMPT TO SELL. ALL ABOVE STIPULATIONS OUTLINED REGARDING CONSIGNMENTS SHALL CARRY OVER WHILE ATTENDING SHOWS. IN ADDITION, CONSIGNOR IS RESPONSIBLE FOR A PORTION OF THE FEES INCURRED. FEES SUCH AS AIRLINE TICKETS, TABLE FEES, HOTEL ROOMS, ETC. THE FEE AMOUNT SHALL BE DEPENDENT ON THE NUMBER OF ITEMS BELONGING TO EACH CONSIGNOR.  THE TOTAL FEES INCURRED SHALL BE DIVIDED THE TOTAL NUMBER OF ITEMS, THEN AGAIN FOR THE NUMBER OF ITEMS BELONGING TO EACH INDIVIDUAL CONSIGNEE.
  14. BUYER(S) THROUGH THE ACT OF PURCHASE OF CONSIGNMENT ITEMS THROUGH YAKIBA, DO HEREBY WAIVE, RELINQUISH AND RELEASE CONSIGNEE YAKIBA, MARSHALL PROPERTIES LLC., ITS OWNERS AND AGENTS FROM ANY AND ALL LIABILITIES WHICH MAY ARISE FROM LOSS, THEFT, DAMAGE, FLOOD, FIRE OR DISASTER WHILE WHILE UNDER CONSIGNMENT WITH YAKIBA.

TERM PAYMENTS:

TERM PAYMENTS ARE CONSIDERED IF THE CRITERIA IS MET.

D.) PAYMENTS ARE TO BE RECEIVED OR POSTMARKED NO LATER THAN THE FIFTH DAY OF EVERY MONTH. LATE PAYMENTS WILL BE PENALIZED WITH AN ADDITIONAL $35.00 LATE FEE, DUE  ALONG WITH THE FOLLOWING MONTH’S PAYMENT.

E.) THREE LATE PAYMENTS, THREE PARTIAL PAYMENTS OR NO PAYMENTS FOR THREE CONSECUTIVE MONTHS, SHALL CONSTITUTE A BREACH OF THESE TERMS.

E.) ITEMS WILL NOT BE RELEASED UNTIL ALL PAYMENTS INCLUDING LATE FEES HAVE BEEN PAID.

F.) DEPOSITS ARE ACCEPTED “IN LIEU OF PAYMENT”. DEPOSITS ALONG WITH ANY/ALL PAYMENTS SHALL BE FORFEITED IN THE EVENT OF DEFAULT OF PAYMENT BY THE BUYER, REGARDLESS OF THE REASON.

G.) ANY BREACH OF THESE TERMS SHALL RESULT IN ALL MONEY’S PAID BEING FORFEITED AND THE ITEM BEING RETURNED TO STOCK, AND AGAIN OFFERED FOR SALE.

H.) THE SALE OF ALL ITEMS PAID OVER TIME SHALL BE FINAL, WITH NO RETURNS AND NO WARRANTIES OR GUARANTEES GIVEN OR IMPLIED.

TERM PAYMENTS ARE NOT OFFERED ON CONSIGNMENT ITEMS UNLESS EXPRESSLY NOTED.

RETURNS:

Yakiba must be notified prior to any returns being shipped. Intent to return must be received by Yakiba prior to the end of the 48-hr. inspection period and is subject to the same conditions as the 48-hr. inspection period.

Items will not be accepted without prior confirmation.

The item must be returned in the same condition as sent. Buyer will be liable for item until return is considered received. Buyer will receive a full refund minus shipping/handling, insurance and or any fees incurred in shipping or sale.

YAKIBA, reserves the sole right of final determination in regard to returned item condition.

RETURNING ITEMS DAMAGED IN SHIPPING:

DO NOT RETURN TO YAKIBA UNTIL INSTRUCTED TO DO SO.

a.) Send detailed description and photos of the damage, this must include inside and outside of the package. Keep item and package until notified otherwise.

b.) Buyer is responsible for filing damage claim with shipper.

c.) Obtain two quotes, one from an authorized appraiser, one from an authorized antique restoration company. These should include repair costs and property devaluation.

d.) Once claim is filed, mail original claim copy, appraisal, repair cost quote, photos and detailed description of damage to the address which will be furnished.
